A Sample (in audio production) is a portion of a pre-existing sound recording or musical composition that is incorporated into a new musical work.

Sampling is a widely used technique in modern music, particularly prevalent in hip-hop, electronic music, and pop. It involves taking a snippet of audio—which could be anything from a drum beat, a vocal phrase, a melody, or an instrumental loop—from an existing recording and repurposing it in a new song. This can be done by directly lifting the audio, manipulating it (e.g., changing pitch or tempo), or using it as a foundational element for an entirely new composition. Sampling allows artists to draw upon a vast sonic palette, reference musical history, and create innovative sounds.

However, the creative use of samples comes with significant legal considerations. Because both the Master Recording and the underlying Musical Composition are copyrighted, using a sample without proper authorization constitutes copyright infringement. This necessitates a process called Sample Clearance, where permission must be obtained from both the owner of the sound recording (typically the record label) and the owner of the musical composition (the music publisher/songwriter). Failure to clear samples can lead to costly legal disputes, Takedowns, and financial penalties, making it a critical step for any artist incorporating sampled material into their commercial releases.

A hip-hop producer might sample a classic soul vocal hook and build an entirely new beat around it. Or an electronic artist might sample a unique drum sound from an obscure 70s funk record to give their track a distinctive groove.
